Terms & Conditions
Following terms and conditions apply to the use of:
– website (www.shopperinput.com) (“Website”);
– mobile applications (“App”):
– for iPhone, iPad and other devices using the iPhone OS and
– for devices using another OS
The Website is operated, and the Applications provided by Shopper Input (“we” or “us”).
We will refer to the Website and Applications together as the “Shopper Input”
Your use of the Shopper Input will be subject to these terms and by using the Shopper Input you agree to be bound by them.
This agreement is in effect as of May 6, 2014.
Billing and Special Fees (Fees And Payment)
Shopper Input charges fees and collects payment in advance for each Service Engagement. You must provide Shopper Input with valid credit card or approved purchase order information as a condition to signing up for the Service. You agree to provide Shopper Input with complete and accurate billing and contact information, including but not limited to, Customer’s legal name, street address, e-mail address, and the name and telephone number of an authorized billing contact. You agree to update this information within thirty (30) days of any change to it. If the contact information you have provided is false or fraudulent, Shopper Input reserves the right to terminate your access to the Service, and any outstanding Service Engagement, in addition to any legal remedies. Shopper Input will automatically bill your credit card or issue an invoice for the Fee set forth in each Service Engagement prior to commencing such Service Engagement. The Clients will be charged a one-time fee as well as a percentage of the stated number of Mystery Shopping jobs they wish to have carried out. A mystery shopping job shall be considered complete once the Deliverables have been accepted by Customer. If one or more job is not completed, Shopper Input shall issue a credit to you equal to the Fees for such jobs, which you may apply against future amounts owed by you to Shopper Input pursuant to this Agreement. If you believe that any invoice is incorrect, you must contact us in writing within sixty (60) days of the invoice date of the invoice containing the amount in question to be eligible to receive an adjustment or credit.
Limitation of Warranties
By using our website and app, you understand and agree that all Resources we provide are “as it is” and “as available”. Use of the service is at your own risk. This means that we do not represent or warrant to you that:
i) the use of our Resources will meet your needs or requirements.
ii) the use of our Resources will be uninterrupted, timely, secure or free from errors.
iii) the information obtained by using our Resources will be accurate or reliable, and
iv) any defects in the operation or functionality of any Resources we provide will be repaired or corrected.
Furthermore, you understand and agree that:
v) any content downloaded or otherwise obtained through the use of our Resources is done at your own discretion and risk, and that you are solely responsible for any damage to your computer or other devices for any loss of data that may result from the download of such content.
Limitation of Liability
In conjunction with the Limitation of Warranties as explained above, you expressly understand and agree that any claim against us shall be limited to the amount you paid, if any, for use of products and/or services. Shopper Input will not be liable for any direct, indirect, incidental, consequential or exemplary loss or damages which may be incurred by you as a result of using our Resources, or as a result of any changes, data loss or corruption, cancellation, loss of access, or downtime to the full extent that applicable limitation of liability laws apply.
ShopperInput requires that the shopper nor any member of their immediate family have a material, personal or financial relationship with the company the assignment relates to, or to any of its direct competitors. They have to certify that no other relationship, bias or ethical conflict exists which will prevent them from performing this assignment fairly.
All content and materials available on www.shopperinput.com, including but not limited to text, graphics, website name, code, images and logos, trademarks, copyrights, videos and all Intellectual Property Rights related thereto are the exclusive property of Shopper Input, and are protected by applicable copyright and trademark law. Except as explicitly provided herein, nothing in this Agreement shall be deemed to create a license in or under any such Intellectual Property Rights. Use of the Shopper Input Content or materials on the Shopper Input website and app for any purpose not expressly permitted by this Agreement is prohibited. Any inappropriate use, including but not limited to the reproduction, distribution, display or transmission of any content on this site and app is strictly prohibited, unless specifically authorized by Shopper Input. Any shopper generated content is the property of Shopper Input.
Termination Without Cause. Either party may terminate this Agreement without cause, effective immediately upon notice to the other party, at any time when there are no outstanding Service Engagements or unpaid balances due hereunder.
Refund Terms. If you have not received ShopperInput services as promised, you can refund the cost of your order in exchange for a written request printed on your company’s letterhead detailing legitimate reasons for this refund. Should the initial findings provided by Shoppers to Client not be accepted for up to a period of 5 days, ShopperInput retains the right to charge the Client for the full service.
Code of conduct
By using the ShopperInput website or mobile app you indicate that you have read, understand, and agree to follow the principles of honesty, professionalism, fairness, and confidentiality that are outlined in this agreement.
- I commit to ShopperInput’s principle of helping our clients understand the quality of the service they provide, and promoting service excellence.
- I confirm that my participation in any assignment is based on voluntary informed consent.
- I will respect the rights and well being of all individuals involved in all the assignments.
- I will perform all assignment to the best of my ability, with honesty and integrity.
- I will honour all confidentiality agreements.
- I will submit all reports on or before the deadline, and release the job immediately if I cannot perform the assignment for any reason.
- I will read the shopper notes thoroughly before carrying out any assignment.
- I will not disrupt the normal business flow of an operation in the process of performing the job.
- I will not announce myself as a mystery shopper to the business/branch being evaluated unless given specific instructions by the mystery shopping company
- I will not accept a mystery shopping assignment for a business that I, my family or friends work for.
- I will not contact a client directly without approval of Shopper Input
